Public Offer

General Provisions

This document constitutes a public offer by Individual Entrepreneur Anna Sergeevna Brodskaya, registered in the Republic of Armenia, Registration No. 206.1588633, TIN 20316157, operating under the name Dilijan Tour.

This Public Offer sets out the terms for providing services to individuals relating to the organisation and conduct of guided walking tours, hikes, and walking routes in Dilijan and its surroundings.

In this Public Offer, Dilijan Tour is referred to as the “Service Provider”, and the individual making a booking is referred to as the “Customer”.

Persons directly participating in a route are referred to as “Participants”.

Subject of the Agreement

The Service Provider organises and conducts the walking tour, hike, or route selected by the Customer, and the Customer accepts and pays for the service in accordance with this Public Offer.

Depending on the selected route, the price may include:

• guidance and accompaniment along the route;
• historical and tour information;
• trekking poles;
• a snack;
• transfer;
• other services expressly stated in the description of the selected route.

The exact content of the service is determined by the description of the selected route published on the website and applicable at the time the booking is confirmed.

Route Information

Before making a booking, the Customer is given the opportunity to review the main characteristics of the selected route.

The route page and/or booking confirmation may specify, as applicable:

• the direction and main points of the route;
• approximate distance;
• approximate duration;
• difficulty level;
• starting time;
• meeting point or the procedure for determining it;
• participation price;
• services included in the price;
• material requirements applicable to Participants.

The stated duration is approximate and may vary depending on the pace of the group, the number and duration of stops, weather conditions, trail conditions, and other objective circumstances.

Booking and Formation of the Agreement

A route may be booked through a form on dilijantour.com, through Telegram, or through another communication channel offered by the Service Provider.

To make a booking request, the Customer provides the information reasonably required to organise the service, including their name, contact details, selected route, date, and number of Participants.

Submission of a booking request does not itself guarantee availability for the selected date.

A booking is considered confirmed once the Customer receives confirmation from the Service Provider.

By accepting this Public Offer, the Customer confirms that they had the opportunity to review this Public Offer and the terms of the selected route before entering into the agreement.

The Customer may save or print this Public Offer using the functions of their browser or device.

Price and Payment

The participation price is stated on the page of the relevant route and is confirmed when the booking is made.

Payment may be made in cash or by an available QR payment method.

Unless otherwise expressly stated, prices are quoted in Armenian drams (AMD).

The Service Provider does not charge additional fees that have not been agreed with the Customer in advance, except for additional services separately requested by the Customer.

Cancellation by the Customer

The Customer may cancel their participation by notifying the Service Provider through a communication channel used by the parties.

As no advance payment is required, no cancellation fee is charged.

Customers are kindly requested to provide notice of cancellation as early as possible so that the place may be offered to another Participant.

Failure to arrive at the agreed starting time and meeting point without prior notice is treated as a cancellation of participation.

Weather and Route Changes

Walking routes take place outdoors in natural environments. Their operation depends on weather conditions, trail conditions, forest and road conditions, and other circumstances affecting the safety of Participants.

Where required by weather, trail conditions, or safety considerations, the Service Provider may:

• change the starting time;
• offer another date;
• offer an alternative route;
• change a section of the route;
• shorten the route;
• end the route early;
• cancel the walk.

Where reasonably possible, the Service Provider will inform the Customer of material changes in advance.

If the Service Provider cancels the route before it starts, the Customer is not required to pay.

If payment has already been made for any reason and the Service Provider cancels the service before it begins, the amount paid for the cancelled service will be refunded to the Customer.

Physical Activity

Walking routes take place in natural terrain and involve physical activity, including walking on forest and mountain trails, uneven surfaces, ascents, and descents.

The main characteristics of each route are published on its route page so that Participants can assess the expected level of physical activity.

This is only a practical description of the expected level of physical activity. It is not medical advice, a medical assessment, or a guarantee that a particular person is able to participate.

Each adult Participant is responsible for assessing their own physical capabilities.

Where circumstances may materially affect a person's ability to complete the route safely, the Participant should obtain any appropriate professional advice before taking part.

Minors

Children aged 12 and over may participate in standard Dilijan Tour routes.

A minor may participate only when accompanied by a parent or another legal representative .

The parent or legal representative is responsible for assessing the child's physical readiness for the selected route and for ensuring that the child follows the applicable safety rules and reasonable instructions of the guide.

Different age requirements may be established for a particular route where justified by its nature or level of difficulty.

Safety Rules

During the route, Participants must follow reasonable instructions from the guide relating to the safety of the group.

Participants must:

• wear clothing and footwear suitable for the route and weather conditions;
• follow the guide's instructions on potentially hazardous sections;
• not leave the group without prior agreement;
• avoid conduct that creates an obvious danger to themselves or other Participants;
• treat nature and historical and cultural sites with appropriate care.

The Service Provider may terminate the participation of a person who seriously breaches safety rules or creates a real risk to themselves or others.

Where necessary, the Service Provider may contact emergency services.

Trekking Poles and Other Equipment

Where trekking poles are included in the selected route, they are provided to Participants for the duration of the route at no additional charge.

Before the walk, the Service Provider may assist with adjusting the poles and explain the basic principles of their use.

Equipment provided by the Service Provider must be used for its intended purpose and returned after completion of the route.

Liability of the Parties

The Service Provider undertakes to provide the services in good faith and to take reasonable measures for the safety of Participants, taking into account the nature of the route and the actual conditions in which it is conducted.

The Service Provider is liable for breach of its obligations in accordance with the legislation of the Republic of Armenia.

Nothing in this Public Offer excludes or limits the liability of the Service Provider where such exclusion or limitation is prohibited by applicable law.

Where the Service Provider is not at fault, it is not responsible for consequences directly resulting from:

• a Participant's breach of safety rules;
• failure to follow reasonable instructions of the guide;
• a Participant leaving the route without agreement;
• inaccurate information provided by a Participant that directly affects the safe provision of the service;
• acts of third parties outside the reasonable control of the Service Provider.

Natural routes may include uneven terrain, stones, tree roots, mud, slippery surfaces, ascents and descents, as well as changing weather conditions.

Circumstances Beyond Reasonable Control

A route may be affected by circumstances that the parties cannot reasonably prevent, including dangerous weather, natural events, fires, restrictions on access to an area, emergencies, decisions of state or local authorities, and other similar circumstances.

In such circumstances, the Service Provider may change, postpone, or cancel the route.

Where possible, the parties may agree on another date or a suitable alternative route.

If the service is cancelled before it begins and the Customer has not paid for it, no payment obligation arises.

Personal Data

To process an enquiry, confirm a booking, communicate with the Customer, and organise the service, the Service Provider processes personal data to the extent necessary for those purposes.

Personal data is processed in accordance with the legislation of the Republic of Armenia and the Dilijan Tour Privacy & Personal Data Policy .

Depending on the circumstances, the data processed may include a name, contact information, booking details, number of Participants, selected route, information required to arrange a transfer, and other information provided by the Customer for the purpose of organising the service.

Where the Customer provides personal data relating to other Participants, the Customer confirms that there is a lawful basis for providing that data to the Service Provider.

Providing personal data for a booking does not automatically constitute consent to receive advertising or marketing communications .

Photographs and Video

Photographs and video may be taken during routes.

Booking a service does not, by itself, constitute consent to the use of a Participant's identifiable image in advertising materials, social media, or on the Dilijan Tour website.

Where consent is required for public or promotional use of a Participant's image, or the image of a minor, such consent will be requested separately.

Enquiries and Complaints

Questions, comments, and complaints relating to the provision of services may be sent to:

It is recommended that the enquiry include the Customer's name, route name and date, contact information, and the circumstances relevant to the enquiry.

The parties will seek to resolve disagreements through communication and negotiation.

Where a dispute cannot be resolved in this manner, it will be resolved in accordance with the legislation of the Republic of Armenia.

Nothing in this Public Offer limits a consumer's rights under applicable law to apply to a competent authority or court.

Changes to This Public Offer

The Service Provider may amend this Public Offer.

The current version is published on dilijantour.com.

A new version applies to bookings made after its publication, unless otherwise required by law.

A booking already confirmed remains subject to the terms applicable when it was confirmed, except for changes required by mandatory law or separately agreed between the parties.

Governing Law

This Public Offer, the formation of the agreement, provision of the services, and the relationship between the Service Provider and the Customer are governed by the laws of the Republic of Armenia.

Consumer rights provided by mandatory provisions of the legislation of the Republic of Armenia remain unaffected by this Public Offer.
